These Terms of Use constitute an agreement between you and Lotus Coaching Services, doing business as FocusLotus ("FocusLotus," "we," "us" or "our"). By creating an account, accessing or using FocusLotus, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.
You must be at least 13 years old to use FocusLotus. Users under 18 may use it only with parent or guardian permission and supervision. FocusLotus is not intended for children under 13.
FocusLotus provides tools for executive functioning, task and project management, planning, time management, habits, academic and career organization, accountability, mindfulness, meal and budget planning, coaching resources, and calendar or third-party integrations. Features may change over time.
FocusLotus is an educational, coaching, organization and productivity tool. It is not a medical provider, mental-health provider, diagnostic service, psychotherapy service or emergency service. Information and automated suggestions are not substitutes for professional advice. For an emergency or risk of harm, call 911. In the United States, call or text 988 for the Suicide and Crisis Lifeline.
Coaching scope, fees, scheduling and cancellation rules may be governed by a separate coaching agreement. Using the app does not establish a counselor-client, therapist-client, physician-patient or other licensed healthcare relationship.
You agree to provide accurate information, protect your password, use reasonable security precautions and notify us of suspected unauthorized access. We may suspend compromised accounts or accounts used in violation of these Terms.
By connecting Google Calendar, D2L or another service, you authorize FocusLotus to access information covered by approved permissions. You may disconnect a service at any time. Third-party services are governed by their own terms and policies.
Some features may require payment. Before purchase, FocusLotus will display the price, billing frequency and material terms. Unless otherwise stated, subscriptions renew automatically; cancellation stops future renewal but does not automatically create a refund. Manage or cancel through account settings in the app or the billing portal.
You may not use FocusLotus unlawfully; harass or impersonate others; access another account; upload malware; bypass security; scrape data without permission; reverse engineer except where legally permitted; store illegal content; misrepresent output as professional advice; or resell the service without authorization.
You retain ownership of content you enter. You grant FocusLotus a limited, nonexclusive license to host, process, reproduce and display it only as reasonably necessary to operate, secure and improve the service. You are responsible for maintaining copies of important information.
The FocusLotus name, logo, design, software, worksheets, educational materials, graphics and original content belong to Lotus Coaching Services or its licensors. You receive a limited, personal, nonexclusive, nontransferable and revocable right to use the service.
Automated or AI-generated suggestions may contain errors or omissions. Review all output carefully and do not submit another person's confidential information without permission.
We do not guarantee uninterrupted or error-free access. We may modify features, perform maintenance, update technical requirements or limit access for security reasons.
FocusLotus is provided "as is" and "as available" to the extent permitted by law. We do not guarantee availability, error-free operation, accurate automated recommendations, particular outcomes or continued availability of third-party integrations.
To the fullest extent permitted by law, Lotus Coaching Services and its owners, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential or punitive damages. Total liability will not exceed the amount paid to FocusLotus during the 12 months preceding the event giving rise to the claim, except where prohibited by law.
To the extent permitted by law, you agree to indemnify Lotus Coaching Services and its owners, employees, contractors and affiliates for claims arising from unlawful use, submitted content, violation of these Terms or violation of another person's rights.
You may stop using FocusLotus at any time. We may suspend or terminate access for material violations, security risks, nonpayment or unlawful use. Provisions that reasonably should survive termination will remain effective.
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any proceeding not subject to a separate arbitration agreement will be brought in the state or federal courts located in Fulton County, Georgia, unless applicable law requires otherwise.
To the fullest extent permitted by law, you and FocusLotus agree that any claim or dispute will be brought only in an individual capacity and not as a plaintiff, claimant or class member in any purported class, collective, consolidated or representative proceeding. Unless both parties agree in writing, no court or other decision-maker may combine the claims of more than one person or otherwise preside over any form of class, collective, consolidated or representative proceeding.
If any portion of this class action waiver is found unenforceable, the remaining portions of this section and these Terms will remain in effect.
By opting in to FocusLotus SMS text messaging, you agree to the following terms:
You opt in by checking the SMS opt-in checkbox, providing your mobile phone number, and enabling SMS notifications in your FocusLotus profile settings. Consent is not a condition of any purchase.
Message frequency varies. You may receive up to 3-5 messages per day, depending on the number of scheduled tasks, routines, and enabled reminder types. Messages include task start reminders, end-of-day nudges, daily task due reminders, daily encouragement, daily check-in messages, weekly check-in reminders, routine and habit reminders, and appointment or session reminders.
Message and data rates may apply. Check with your mobile carrier for details on any fees associated with receiving text messages.
You may cancel the SMS service at any time by replying "STOP" to any text message from FocusLotus. Upon opting out, you will receive a confirmation text. You may also disable SMS notifications in your FocusLotus profile settings at any time.
Reply "HELP" to any message for support. For further assistance, contact us at lotusdrpmd@gmail.com or through the FocusLotus app.

FocusLotus is not liable for delayed or undelivered messages. SMS messaging is supported on major US carriers including AT&T, Verizon, T-Mobile, Sprint, US Cellular, and other major wireless carriers. Availability and delivery are subject to carrier limitations.
We may update these Terms to reflect service, business or legal changes. Material changes may be announced in the app, by email or through another reasonable method. Renewed acceptance will be requested when legally required.
